Braintree Council Cracks Down on A12 Illegal Advertising, Levies Heavy Fines

Braintree District Council has successfully prosecuted an individual for unauthorised advertising, leading to a conviction with fines and costs amounting to over £3,000. The case involved Anthony Devito, who was found to have unlawfully used a vehicle for advertising purposes along the A12.

From 8 February to 4 May 2023, a vehicle bearing the logo of Mr. Devito’s business was stationed in a lay-by on the A12, solely for the purpose of advertising. Despite prior advice from the council’s enforcement team regarding the necessity of obtaining advertising consent under the national planning system, Mr. Devito subsequently returned the vehicle to the same location for advertising.At Colchester Magistrates Court on Thursday, 8 February 2024, Mr. Devito received a criminal conviction for his actions and was ordered to pay fines and costs totalling £3050.58.

Councillor Gabrielle Spray, Cabinet Member for Planning and Infrastructure at Braintree District Council, commented on the case:

“Whilst we are always supportive of businesses and the positive benefits they bring to our local economy, residents have made it clear to us that they expect the council to take robust action against those breaching advertising regulations. This case highlights the importance of having advertising consent in place, which is a criminal offence if neglected. We will continue to take appropriate action where necessary.”

This conviction underscores Braintree District Council’s commitment to enforcing advertising regulations and ensuring that local business practices adhere to the established legal framework, safeguarding the interests of the community and maintaining the aesthetic integrity of the local environment.
